Why “The First 48 Counts”
From 3rd April 2025, a reform to Organic Law 6/1985 ( known as the Anti-Okupa Law 2025) came into effect. This empowers the police to remove illegal occupants immediately if notified within the first 48 hours. Due to the fact we visit your property every 24 hours we can provide photographic evidence to the police the property was not occupied the day before. Being in possession of evidence of your authority for us to act on your behalf (detailed below), we liaise with the police immediately to force swift eviction. After the first 48 window closes, the eviction process becomes far more complicated and costly due to the necessity of court action. Although there is now a “fast-track” process, backlogs in the court system will ultimately cause delays leaving squatters in place.
The “First 48 Counts”. If your property is invaded by squatters, we can have them physically removed by the Guardia Civil in the simplest way. After “The First 48 Hours”, it can take months, be extremely costly, without any guarantee of a timeline.
With a copy of your nota simpla and power of attorney to act on your behalf in the case of squatters “First 48 Counts” are your representatives in Spain when it comes to the eviction of squatters in “The First 48”. It is impossible to do this remotely by home owners as you need to be physically present and prove ownership. By giving us the power to act on your behalf, we become that physical presence.
Is checked daily, a photographic record is made and uploaded to your unique, secure account. Our staff are equipped with drones that have video recording capability. Whenever they feel it necessary to investigate a property further, they fly the drone around the property to record any anomalies. Where access is available, a walkaround is undertaken.
Because we visit your property daily, we are the first to know of any unusual activity, for instance a chain on the gate, signs of movement in the property, anything out of place that was not there the previous day. We immediately contact the Guardia Civil and request their presence. New Laws are in place from May 2025 to force their interaction with the home invaders.
With photographic evidence, along with power of attorney to represent you and a copy of your nota simpla, the police are required to evict squatters immediately. Often, home invaders will produce a fake tenancy agreement stating they have lived at the property for a period. We can prove they were not there the previous day and provide photographic evidence.

The problem with squatters in Spain is becoming more of an issue daily. If your property becomes the victim of squatters it is of the utmost importance to be aware at the earliest opportunity. In terms of literally hours, “The First 48 Counts”. If illegal invasion of your property is reported within the First 48 hours, it is a legal requirement for the police to remove squatters without a court order – particularly if it is your primary or secondary residence.
F48C was created to assist in this process. We retain the necessary documents to act on your behalf to force removal of illegal occupants with the police. This includes a single line power of attorney that authorises F48C to act on your behalf purely with regards to squatters. A copy of the Nota Simple (deeds) proves you own the property and this enables the police to remove squatters immediately.
How do we know the property is occupied? – We visit your property on a daily basis. We take photographs and upload them to your dedicated personal web page that you have constant access to. Any change to your property for instance a car in the driveway, or anything out of place, we investigate further and where necessary contact the police immediately. A new squatter tactic is for them to place an extra padlock and chain to a property, or even change the lock on a seemingly unoccupied property. They then wait for days or even weeks to see if anyone intervenes. If the lock remains untouched, they assume the home is not a primary residence – and move in. This way, they avoid the more serious charge of breaking into someone’s home. Our service prevents this happening and saves the time, effort and stress of going to court to evict them, which can take months, cause immense stress and is extremely costly.
